Spouse Visa - Funding and Duration

Post by hn » Fri Oct 29, 2010 11:18 pm

My girlfriend (a Polish resident and Vietnamese citizen, currently living and working in Poland) and I (a British citizen) are planning to get marry (after being with each other for one and a half year). We then hope to apply for a UK Spouse Visa for her to come to England.

I currently earning about £10,000 a year after tax, and have about £15,000 in saving (ISA).

I was wondering is the funding and duration of our situation be adequate for an approval of a UK Spouse Visa?

Many thanks in advance for any help and advice you can give.

There is no minimum time for you to be together in a relationship, as long as you can show evidence of a genuine relationship, visits, regular contact, photos together etc. Regarding finance, the ECO will want to see that after rent or mortgage, council tax and any loan repayments, you will have a minimum of £102.75 remaining weekly. You don't need to include utiltity bills, food or personal spending. Your ISA savings will strengthen the application.
I'm assuming you're both over 21? Are you living and working in the UK at present?

Hello Casa

Thank you very much for your reply, it really help me being more positive about our future. We are both over 21 and I am working and living in the UK.

My only other concern is that, she is a Vietnames citizen, but have a perminate residency in Poland, where she lives and works. When we apply for the Spouse Visa would she need to go back to Vietnam or can she apply it in Poland.

Again thank you in advance for any advice and help you can provide.

If she's legally resident in Poland she will be able to apply from there. We had a similar situation a few years back when I was living in Spain with my Moroccan husband. We applied in Madrid without a problem. In fact applications for spouse visas (for non-EU citizens) submitted in an EU state tend to be a smoother process (and relatively quick) if all the boxes are ticked.
