Dependent of WP holder

Post by yaso74 » Sun Oct 31, 2010 8:47 am

Dear all,
I wish if someone can sort out my problem.
I came to england in feb 2009 with my 8 year old son as a work permit holders wife (my husband is here since 2006 on WP) now just before my husband is about to apply for ILR on WP (5 years WP) for some family reasons we got seperation (or divorce in future, dont know yet).

I want to know that what is my status in UK, as I am about to complete 2 years as dependent. my son goes to school (class 4)

What shall I do. I cannot go back as me and my only son got a life threat there.

Hope someone help me asap.
Thanks.

See also On Spouse Visa- Marriage, marriage breaking down.

If you got back together with your husband, then you (196E) and your son (198) may be included in your husband's ILR application. KOL is required for adults.

If you can prove that your fears are well founded, then you may have an Asylum claim.

but as per my knowledge, asylum can only be claimed right after your arrival in the UK. (i am not sure)
but after spending almost 2 years, can I apply asylum?

You can claim asylum, but there will be a great deal of scepticism because of the late application.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
