Hi i received my hsmp approval letter in august 2006 and on that i got 1 yr hsmp visa for first time and then extended 3 yrs on tier1 under judgement, so i am finishing my 4 yrs soon, could you pls adv me weather i need to apply for ILR or one more yr for extension? i was in UK when i received my HSMP

--> I aplied in May 2006 and received approval letter in August 2006 but i got stamped in april 2007 (i was in UK),

1. When did you apply for HSMP? Before Apr-06 or after?
2. What is the issue date of the initial HSMP leave to remain, that you applied for on basis of HSMP approval?

Hi ya,

1. I don't no exact date of application(Might be in May or June) but i received approval letter August 2006

2. ya I received first extension on basis of HSMP approval letter(Which i still hold),

One More thing, i just want to mention, my friend got 2 yrs initial HSMP, but i just got 1 yrs in 2007, i quried with home office at that time, they advised me will offer you 4 yrs on next extension but on my second extension i got only 3 yrs, which is goin to expire soon?

Since you applied for HSMP after Apr-06 you'll qualify for settlement only after completing 5 years in the UK.

You should have been granted 4 year leave at the time of extension. Contact UKBA to either:
1. get the error rectified, or
2. to ensure that the extension that you now need (to become eligible for settlement) is granted to you free of cost.

If you can find it it will be good as you'll be able to claim that you reported the error at the very beginning and were assured that you'd be granted 4 years leave at the time of extension.

IMHO, it is always best to get confirmation from UKBA in writing (on any issue). You cannot prove, at a later date, what you are told on phone today.
