Settlement (27 months) Visa corrections - Help required

Guys,

Last year august 2009 my wife and baby got 27 months settlement visa from india.Currently both of them are in UK after 1 year i am just checking my daughter's passport and i found out the following corrections

1) At the time i was on ILR and my daughter should get ILE because we applied from outside UK but on her visa they gave normal 27 months visa.For ILE the ‘validity date’ on the visa should match the expiry date on the passport in this case which shouldn't happen.One more thing in her visa clearly says Indefinite leave to enter.

2) In her visa they put sex is wrong instead of female they put male

Could some one please help me how to get these things corrected in her passport?

One more final question

3) My wife is going apply her ILR in jue 2011 so my next question is once my daughter got corrected above corrections is she needs to apply ILR with my wife or she is directly eligible for citizenship.

Using your numbering :=
  1. You are not the first person to be confused by the "date of expiry" on an ILE visa, and I am sure you will not be the last. That date is simply the final date that the ILE can be used to enter the UK .... for the first time, using that ILE visa. After entry to the UK that date can be ignored.
  2. In what way have they indicated the gender of your child?
  3. She has ILE, so does not need to apply for ILR.

Regarding 2 and 3rd points

2)Under sex option ECO put M so it it should be male

3) I can register my child as british now

Vinny's post in obviously helpful. Yes I agree, go for it, file the form MN1 to apply for your daughter's Registration as British.

I would not worry about the apparent mistake about her gender.

I have one more question

I am british citizen through naturalisation and My wife is on 27 months settle ment visa,My daughter as you know she is having ILE

In MN1 for section 1.1 i have to use section 3(5) is it correct

you would like the application considered.

No, I think Section 3(1), given you are British otherwise than by descent.

Section 3(5) would be correct if you were British by descent, but that is not applicable here.

Thanks john.I have strange update from hounslow concil NCS team she says i can't register my baby as british citizen because my wife doesn't have ILR

I told her the following

I am british through Naturalisation

My wife she is on 27 months settlement visa

My baby 22 months with ILE

This is very strange answer from them and i am confused now if i can apply or not.

The message from Hounslow is rubbish. You are British and no doubt you are named on your child's birth certificate. The status of the child's mother is irrelevant.
