When to apply for FLR(M)

Post by prasannakrao » Sun Nov 14, 2010 12:30 am

Hello there,

I have one question here. Could not get the correct answer going through some forums here. Sorry if its a repeat.

I am on tier 1 now. I have been in UK for > 5 yrs. I will b applying for ILR next week. I got married 4 months ago and my wife joined me shortly (as a dependant). Since my wife has not completed 2 yrs in UK as my dependant, I understand that she cant apply for ILR with me now. But her dependant visa is valid till May-2012.

After my ILR, will she be required to get a new visa via FLR(M)? even though her current (t1 dependant) visa is valid till may-2012? Please let me know. Thanks.

Also, if she is required to go for a new visa, when is the earliest and when is the latest she can go for the visa? Can she apply for it along with me next week?

Please let me know.

Thanks,
Prasanna

Hi,

I managed to search thru the form further. One person has referred to a discussion with UKBA, who have said that the T1 dependant visa will NOT become invalid and that the dependant CAN coninue to hold it.

Is this true? If yes, it will save me loads of money.

Thanks..

She may switch immediately after you are granted ILR.
