hi sally12345
thanks for replying.
your advise is appreciated. yes, it was a mistake and my husband had no intentions behind this.
yes, i would mention this but confused how to mention this in the form as it is not a criminal conviction. the form only has tick boxes for criminal convictions. please can you assist?
thanks a million again.

Hi there your welcome if he was not cautioned or anything you may not need to declare this then??? I am sure you only need to say anything if he was taken into custody??

I will speak with a police friend and get back to you regarding this issue.... I understand you want to be honset and thats good I would never steer you away from being honset but not sure, if you need to declare crime or not..

I am hoping others will post to give us an idea however, I wil check for you all the best dont stress you be ok :D

Hi sally12345,
thanks for the reply.
He was not arrested or taken into custody.
he was only given this penalty notice of £80 in the store where this all happened.
he has paid the penalty in full.
I hope they would not refuse my application because of all this. :-(

hi sally12345,
GOT MINE!!:-)
it was damn stressful...
i disclosed it as i thought it would be good to be honest! but caseworker considered as conviction for some reason...even though i mentioned that i have researched on it and it is not same as conviction..
i had good covering letters prepared but the case worker did not even look at them!
anyway,i dont think that the penalty notice comes up on their system as case worker asked me what was penalty notice for..
but i am not 100%sure so its good to declare..
Thanks you sooo much for all your advise...Appreciated!
