Post by dikey2809 » Thu Nov 18, 2010 5:42 pm

Please if some one can provide guidance on transfer of visa from Tier 1 to permanent residence visa (Indefinate Leave to Remain).
I am on Tier 1 i have already completed 3 and half years, the extension is till 2012.
This is when my 5 years under hsmp and tier 1 finishes.
Just wanted to know my eligibility for applying for ILR after 5 years.
Also i have a daughter who was born here. she has my dependant visa till 2012.
I would like to know that does my daughter also has to follow the policy that she cannot stay outside UK for more than 6 months.
She is small and I am plgg to send her to India for a year.
Please guide.

No can tell you today what the rules for settlement may be in 2012. But for settlement (eligibility and application) under current rules, see Chapter 6A - Settlement and Settlement.

For the purpose of settlement, there is no restriction on dependants regarding absences from the UK.
