Out of country tier 1 application, what are the chances?

Out of country tier 1 application, what are the chances?

Hi,

I've been on Tier 2 for the last 17 months and was earning £31K but last month I was made redundant and tried to find a new job but couldnt and now I face an issue. For tier 2, they allow you only 60 days to find a new job or go home out of which 30 days will be used for labour market test which practically gives us 30 days not 60. Now I have 2 options. I could either go for a student visa or go back to Pakistan and apply for Tier 1. I am sure I'll qualify for Tier 1 from there but people have told me not to leave the country otherwise it will be hard to come back.

Looking for an advice on what to do. I have my family wife and 2 kids here with me but now face a deadline of 8th of december.

Personally I want to go for Tier 1.

Why dont you switch to Tier-1 from within the UK... if you are confidenet that you will qualify then apply from here... there are many advantages...

no limits...
no break in residency hence no delay in ILR provided the rules remain the same...

you can stay within UK as long as you have made an application before your current condistions expire...

No the problem is I don't have enough income here to apply for Tier 1 but if I apply from Pakistan then I'll have the required points because I already got a project from a local company there which will give me enough income to apply.

But still I am not sure if leaving UK would be a good idea?

As far as I know you cant apply from Pakistan, as you've earned in England and you cant use Pakistan band D, you'll have to use UK band which is A.

Yes for the money I made in UK it will be calculated with band A but all my income from Pakistan would be band D obviously.

Is this future income, or money that's been made while you've been in th UK?

As explained in the earlier topic, you cannot apply uplift ratio to any income income earned / credited overseas whilst you were physically present and working in the UK.

You may, however, return to Pakistan and when your income earned (through employment and/or self-employment) in Pakistan reaches the level that you need to qualify for Tier 1 (General) you may then apply from there. How soon that may happen depends on how soon you earn enough to score the points you need.
