Points claim for spouse out of country

My spouse has been in UK for an MBA since last september and i have added proof of us living together for the past 2 yrs in the way of joint bank statements, utility bills etc which do carry on to come to our joint address inspite of him being away.

I was told by one immigration consultant yesterday that claiming points for partner could be an issue if the MBA in UK has been mentioned in the application. Mine is an out-of-country application.

Any views or information on this ?
