(1) Please advise which date should be considered while calculating the Qualifying period? i.e. the date of EC was granted or the date of entry in the UK?

2) My current Tier1 (General) visa runs out on 02 May 2011. If either of the above dates are considered for calculating the qualifying period I still need 23 days to complete 5 years of qualifying period if EC grant date is considered or 63 days if the date of entry to the UK is considered.

Do I need to make an extension application under either of the above (applicable) dates [i.e. EC grant date or date of entry in the UK] to complete the qualifying period first or can I send one application form (SET (O)) to BIA explaining the difference in the number of days for qualifying period and pay the relevant fees for both the categories rather than sending the application in two phases i.e. Extension application for 23 days or 63 days (whichever is applicable) and then ILR application once extension application is approved?

1.
Qualifying period is the date of entry in UK

2. You will need to apply for an extension as the gap between the qualifying period and the actual period spent in UK is more than 28 days.
