Seconded Overseas : Income Band

Hi,

I am on deputation to UK since last 18 months from a small Indian company on Work Permit. I wish to file HSMP and need an advise on the income band which should be used in my situation. This is as per the HO guidance for seconded applicants.

My present state is

During this tenure of 18 months, I am being paid my basic salary in India in INR on which I file my India Taxes. I am also being paid an overseas salary, which is a kind of overseas allowance in UK currency (GBP). I do not have any tax details for UK as my company takes care and I am not sure how they show people on deputation to UK.

My overseas allowaces are less than 40k and I cannot file HSMP unless I present myself in Indian Income Band. I understand from the guidance that even though I am deputed in UK for more than 12 months, my original company is still Indian and they pay me from India.

If this stands right, shall I fit myslef in Income Band D (India) and add both the amounts (Rs and Pounds) which makes me eligible.

Or, I cannot show myself as an Indian guy as I am in UK from last 12 months.

Please advise how the latest HO guidance matches my situation.
