Hi

I need you advice on what to do?

my work permit finishes on 14th of December 2010.

I was going to apply residency
but my lawyer said due the the salary being paid is lower than what is stated on the permit (17k instead of 25k per year) I am in breach of the conditions of my permit.

I was aware that the salary was lower than what is stated

but my employers at the time of the application said its just play on words. now my lawyer has backed out in applying on my behalf due to the difference in salary.( i said yes as I think anyone in my position would do the same,would rather stay here and work than go home and not have a visa)

and last Tuesday my employer said it would be on the best interest of both parties for me not to apply for my residence as it could cause problems for me and they might get fined and punished by the immigration department.and i might get blacklisted for taking part in misrepresenting the details of my visa application (by agreeing to work for lower salary even tough i know its a breach)

hence any im assuming my employer would not hand me over my payslips and employee letter which i need for application for ILR.

my questions are

1. is going home and not applying my best option?

2. if i do apply and they found out the difference in salary what would be the consequences for me? would i be banned from applying a uk visa on a different category? as i have been blacklisted?

3. one solicitor I talked to said go ahead with the application and come clean and once it gets refused I can go for an appeal which he said has a good chance of going in my favour. but this means im burning bridges with my employer and will there be consequences for me if the appeal does not go in my favour? would i be banned from entering the uk for life?

please any inputs opinions or advice would be much appreciated as I am short for time and still unsure what to do
my visa runs out 14th Dec!!!

can u not extend the work permit? i am affraid there may not be an easy way out of this, i am not saying i know it all but looks like u clearly knew u were in breach and still decided to go ahead. so why wait till 2 weeks before coming up to expiring the visa to find solution.
