Tier 1 dependant status when Tier1 holder is abroad

Tier 1 dependant status when Tier1 holder is abroad

Hi,
Had a quick question and will appreciate any insights. I am a Tier1 General visa holder and my wife is on a Tier 1 dependent status in UK. We have been on Tier1 for two years now.I have to go to Singapore for the most part of 2011 on my job. My wife still has a job in London and plans to work here atleast for another 7-8 months. I wanted to make sure her status is OK to live in the UK even if i may be gone for the next 7-8 months.

I can't answer that question unfortunately, but how is your wife allowed to work as a dependent of a Tier 1 applicant? I thought this was explicitly disallowed?

Of course she's allowed to work.

In terms of her status, this is just a guess, but as long as your visa is valid, her's is valid as well, so it shouldn't matter that you are out of the country. This is just a guess though.

Dependents of tier 1 have full rights for working the same way as tier 1 main applicant.

While she may not have any problem, you could when it comes to your ILR. You are not allow outside the UK for more than 3 consecutive months or in other terms 180 days. I think you are excluded from the terms if you are abroad for your employment reason.

Hi All,
Thank you so much for the comments. I appreciate all of them. As a Tier 1 dependent, my wife is definitely allowed to work in the UK. Also we are not planning to settle here, so we do not plan to apply for permanent residency at the end of the Tier1 tenure. I was just trying to make sure her status in the country is OK even if i am out of the country for the next seven to eight months. My guess is that as long as my Tier1 visa is valid, she should be OK but was unsure, hence the query. Appreciate any help you can give.
