Tier1 previous earning short query

Hi

I am in UK in Tier 2 visa (inter company transfer) category. I am planning to switch to Tier 1 category but short in my previous earning.
In last 12 month I had earning from 3 Sources.

Source 1) From the same employer who issued sponsorship for my present Tier 2.

Source 2) Earning from Business – Commission from trading goods like oil seeds and grain. I do not have any firm or company registered on my name.

Source 3) I worked as a free lancer programmer and earned from the software projects I delivered.

If I combine income from all sources then I am qualifying for Tier 1 previous earning req. But what document I should produce for Source 2 and Source 3 income (mentioned above).

For Source 1 income I have Payslip, letter from my employer and Bank statement to prove earning.

Please reply with your view on my case and possible solution.

Was your source 2 and 3 earnings in line with the requirements for Tier 2????

I didn't show source 2 and source 3 earning at the time I applied for tier 2 since my source 1 earning was sufficient for the tier 2 application.

Are you allwed to work for other employer while on Tier 2?

No, what I am saying is that are you not possibly in breach of your conditions of stay for your Tier 2 visa? If you are, you cannot use this income to apply for a Tier 1 visa.

Read the section on extra jobs and second jobs on the UKBA website.

From what you have said, it sounds like source 2 and 3 is NOT in the same profession (well at least one of the two) for which you were given your Tier 2 visa - in that case you are in breach of your conditions and you cannot therefore claim this as income.

Only if it's less than 20 hours a week and in the same profession as your Certificate of Sponsorship was issued for, otherwise you need to get another one.

I came to UK in tier 2 just 2 months back and the income from source 2 and source 3 were in my native country not in Uk so there is no point of breaching tier 2 work guideline.
Now for tier 1 application i want to claim Source 2 and Source 3 income (which were not earned during my last 2 month Uk stay).
