hsmp+tier 1 JR-LIFE IN UK TEST and other douts

i had HSMP for 2 years(October 2006-October 2008) then i applied for tier 1 under JR and got extension for three years (November2008 to November 2011)i have couple of doubts which need clearing:

1:will there be any new rule coming in JULY 2011? I heard they are not, just to confirm/

2}do i have to take life in uk test?

3:i just got married, will my wife get ILR with me?

4)i was on SEGS before HSMP. will that be counted when i apply for ILR?

5) anything that i need to be aware of ?i know the 90 days out of country criteria however not sure if dates of travelling and weekends are included in 90 days or not.

I am in the same boat as you, my HSMP was extended as Tier 1 under JR and I finish 5 years in Nov 2011 as well.
Not only this, I was on SEGS before initial HSMP as well and have been told by a few people now that SEGS does NOT count towards the 5 year of the ILR otherwise I would have been able to apply now!

I know the new rules being talked about for ILR for Tier 1 come into effect in Apr 11 which require that for ILR you should have a minimum income that was needed on your last extension.

Now considering there was no minimum salary required for HSMP and the Tier 1 switch over under JR was more of a transitional arrangement (and even then no minimum salary was required under JR) so hopefully same would be applied for ILR for existing people under your and mine situation.

Can someone please throw some more light on this, pleaseee

looks like we are in a almost situation. how important you think it is to have ALL the p60s? i m earning 19K, n i really hope that there wudnt b any salary requirement for people like us who got tier 1 after hsmp JR

I am in the same boat. Looks like we may not need any income proof, as was not required for transition from HSMP (under JR) to Tier1 (General) last time when we extended.

for the p60s issue itself, as long as you have your salary slips instead it should be ok tbh but can't say for sure

I am earning even less than you really and don't think the new apr rules ilr will affect us but would be nice if someone can give a more affirmative opinion really.

It doesnt matter if you dont have all P60s. Keep all your salary slips and if possible bank statements.

Thanxs a lot. that leave me with another question. do i still need to give life in uk test? if yes, where can i find the relevent books/material..whats is the cost of this test?

I was wondering about this too, as I got my initial HSMP approval letter on 30th Oct 06 hence I actually fall in the JR for LIUK, however I am still in 2 minds whether to apply without it or get it over and done with, as will be applying for ILR in Feb11. I might pop down to the local exam centre and find out how often they run the test and get more info etc.

I got HSMP in Oct-2006, got extension under HSMP-JR, they have changed my visa from HSMP to Tier(1) after the extension. I will apply for ILR by theend of next year.
I have gone through the ILR form SET(O). The form has clear guidance and section for the migrants who came before 03 Apr 2006.
Bue there are no section for the migrants came between 03 Apr and 07 Nov 2006. The guidance notes for the Form SET(O) describes the HSMP-JR(Settlement) as follows. Section 2, Page 2 of guidance notes for Form SET(O).
""* If you applied successfully under the highly skilled migrant programme (HSMP) before 3 April 2006, your application for indefinite leave to remain will be considered under the terms of the HSMP indefinite leave to remain (ILR) judicial review policy document.""

As you guys know UKBA needs a small excuse and mistake from applicant to reject their application. I am thinking to write a letter to UKBA to explain the situation and ask them to request the letter. The problem is that I am not sure to who and where to send the letter.

Please guys share your thoughts anout this.

You need to have a full copy of the policy document which explains the situation, when you apply in person or post your form.
There is nothing else you can do for now as youre not yet eligible to apply.

I have got a question. This discussion might have been on this forum before. If any body remembers the link please post it here.

1. I got 2year HSMP visa under the rules in place April2006-Nov2006, 'out of country application'.

2. I got extension under judicial review for further 3 years 'from the date my fisrt entry clearance was granted' and not from the date I 'entered' in UK.

3. Now my ILR would be due after completing '5' years under the catagory as per judicial review.

At the end of my extension I will be short to reaching 5 years threshold as per guidance available. i.e. I entered late after granting my initial HSMP Visa.

When I got my extension a letter was also sent to me by ukba saying that this extension would be enough for me to reach the settlement threshold that made me feel that they will consider it from the date of visa granted. But now I have seen it in ukba website that for out of country applications it would be from the date of entry.

Now it seems I need to apply for another extension just for only 2 months before my ILR????? (spending lots of money on application fees)

Does any body share any ideas or has any body got extension for 3 years from the date of entry to cover their 5 years threshold. I remember some of the posts on this forum where some members sent there passports back to ukba to get correction in FLR dates.

I appreciate your responses.
