Spousal Visa refusal

My husband who has refugee status and I (had student visa till 31/10) got married on 27/11/09. I didn't apply for my spousal visa till 18 Sept this year as still had my stdent visa. We submitted everything that was needed for application (marriage cert, bank statements, bills, etc). On the 15/11 we received a refusal. the reason says 'the Secretary of State is not satisfied that you are married to or the civil partner of a person present and settled in the UK'. My solicitor has made an appeal since I had a right of appeal. But what I need to know is do we even have a case here? Are they questioning his stay here because he does not have indefinite leave to remain but refugee status (5yrs). Pls help. Ange
