Spouse status if I become citizen

Post by seth1991 » Mon Dec 13, 2010 12:28 pm

I’m about to apply for my neutralization in Jan 2011. My wife is a depended on my ILR permit from June 2010. We got married in April 2010. I want to know how her status will be effected if I move from ILR to British citizen?

I'm confused. A dependant is someone who is a dependant of someone on a temporary visa.

If you have ILR then you are "present and settled" and she would have applied for a spouse visa or extended her leave using FLR(M).

Can you clarify her status - what does her visa say in her passport?

Sorry for the confusion. She is on a spouse visa. She changed from a work permit to a spouse visa after we got married.

In which case - there is no difference in her visa - she is still a spouse of someone 'present and settled' in the UK.

She will need to apply for her ILR in June 2012 (based on what you've told us).
