Hi,

I made the worst decision ever to make a postal application to the crooks and they have some of my documents how do I get them back?

Anyone been there? Thank god they sent our passports back and i fear if they didnt no visa or ILR or anything.

Postal application in my opinion is suicide.

If UKBA has lost the documents, as you claim in the subject, how can you expect UKBA to return them?

yes I made sure I made copies, but its my bank statements and wage slips which are an absolute nightmare to get again as it takes 10 working days by the bank and company you work for always questions why soon as you mention immigration purposes I strongly advise people when requesting bank/wage statements do not mention IMMIGRATION or Home office you will scare them away and wont get them! I have 1 weeks left till my wife visa runs out.

With new laws coming out every week postal application is suicide and advise everyone against it especially in the case of immigration status as its a huge deal not like losing a letter where it can be replaced easily this could separate a couple for years until they get status again as well as go through the 5 year appeals process.

They sent your passports back without endorsing it with the ILR? Did they include any explanation?

Vinny, there are several threads by the OP. The application was rejected as the payment didn't go through. The HO say the payment page wasn't submitted. The OP says it was. His wife is now applying at a PEO.
Azimscot, your wife's visa expires on Wednesday (5th) doesn't it? Not in a week's time? When do you have your PEO appointment?

This is a sad situation indeed.
Op should try his best to put something in the post even if he doesnt have all the documents, with an explanition, so at least the wife will be covered under section 3c

Azimscot has said he's booked a PEO appointment. I was checking the date to make sure it's before expiry which appears to be on the 5th Jan.

visa expires on the 08/01 and got an appoitment for the 06/01. It just means that anyone submitting an application today there application form could be invalid tomorrow or next week while they process your form.

I'm not sure what you mean by this. Does it refer to the fact that the HO didn't process your payment, thereby leaving you with an invalid application...and you now have to pay the increased fee with your new application?
Members need to be clear (and I believe I've explained this 3 times now) that the increased fee will only apply if the original application is rejected and not simply if the fees rise while the valid application is being processed.

Very much confusing !!!!!

I don't know how you have come to this conclusion(!!!). Visa category, like long residence, people have only one option... 'Postal Application' and if you are right... then on long residence category most of the application would be invalid... that just an example. I believe majority of the visa application reach to the UKBA via post not in person.

They made my fee invalid as the rules of the game changed. July 2010 was the previous version of form that came out with postal fees at Â£840 November 22nd new version of app form out new fees Â£900 Application submitted in October 1st how were we supposed to know they were changing the fees when the form was already submitted.

What I am saying is what the home office lady told me 95% of postal applications take 6 months what she also forgot to tell me is that they keep some of your documents that they seem fit!

Overall regardless of how peed off I am its a good lesson for me and others to follow regardless if its immigration or a dispute better in person that sending your most valuable items to the unknown.

if you claim that you send the form on october 1st then you must have sent it by recorded delivery and which in turn means you have the proof of date on which you send it.

you will be charged fees correct on the day which you send applicaiton (if sent by royal mail) and on the day which home office receives applicaiton (if sent by courier). home office can not charge you if fee increases due to a delay on their part only,, however if you made an error in original applicaiton and you have to send that back again then they can charge new fees.....
