Hi,
I am going to complete my 5 yrs in UK in which duration I have been on work permit and tier 1.
I usually go to India for about a month in a year, except on one instance last year when due to my mom's health condition, I had to stay there for a period of 96 days at a stretch. part of this break (3 weeks) was covered by my annual leave and rest of the time I was working from india.
I have salary slips, P60 and bank statements stating that i was receiving my salary in UK and paying my tax here. I could get a letter from my employer stating that there was no break in employment and all this time I have been based in UK. However, due to the nature of the arrangement by which I was allowed to work from home in India on an urgent basis, I can not get anything from the official HR of my company which states that I was required to work from India, or that I was there on business trip.
Presently, the total days I've spent outside UK comes to 225, with the above break being the longest at 96 days. 150 days from the above are annual leave (paid holidays)and the other 75 is the time when i was working from India (again paid).
I had a few queries. It would be of immense help if somebody could help out.
1.I have heard that annual leaves are disregarded. If so, then the 96 day gap actually translates to 75? Is that acceptable?
2.i have also read somewhere that apart from business trips, compelling reasons of compassionate nature are also acceptable. is this true? has there been any such instance?
3. Also, would the total of 225 days cause any issues?
4. What would be the best course of action?
