Tier 1 General Appeal & Fresh Application

My Tier 1 General initial application was refused and sent for an Appeal. I hope I'll get success. After the application submission, my previous visa was already expired. If I fail the appeal, can I submit new application for Student visa within the valid period instead of appealing high court or leaving the UK ???

you can't do anything in-country and MUST wait until you get the decision on your appeal...

if you wish to make a new app, you must leave country, withdraw your appeal, and then make a new app.

Why Can't Apply for Student Visa While in Tier1(G) Appeal???

Student Visa Application clearly says that someone is waiting for appeal hearing can apply for Student Visa as follows. Seniors suggestions are appreciated:

The following are from the In-country Tier 4 (General) Student Visa Application Form:
D20. Does the student currently have any other applications with us (on which he/she is awaiting a decision) Or an appeal with the asylum and Immigration Tribunal (which is yet to be heard)?

Yes --- -go to annex for part D –question AD12 if you have an outstanding
appeal.

aD12. Does the student currently have an appeal with the asylum and Immigration Tribunal which is yet to be heard?

Yes --- - go to question AD13

aD13. Give details of the appeal, including the date the appeal was submitted, what the appeal is for (the category) and the payment reference number for the original application (where applicable):

Yes there is a section to mark 'yes' / 'no' but if you mark 'yes' they will return your application form without processing with a letter that you should wait for pending appeal decision.

And with the further case detail you provided they also inform relevant person/tribunal that applicant is desperately trying to get LTR in UK with other ways which impact on appeal decision as well.
