Help needed on ILR for me and my dependant....

Post by mds2011 » Mon Jan 10, 2011 6:27 pm

Hi,
Presently I am in Tier 1 General Migrant visa.My visa is going to expire on 9th June 2011 and I will be elligible for ILR.
My wife is on dependant Tier 1 General Migrant visa .Her visa will also expire on 9th June 2011.
I got married on 1st May 2009.My wife got her visa on 19th May 2009 and came to UK on 6thJune 2009.
My questions are:
a>Can I include my wife as my dependant for ILR through SET(O)?

b>By the time I am planning to apply for ILR(end of May),my wife will be fews days(approx a week) behind her 2 year completion of staying in UK.
Will this affect the ILR application through SET(O)?

c>Is her elligiblity to apply for ILR in SET(O) form depends on (2 yrs of her staying in UK) or (the 2 years can be counted from the day she got her visa)?

d>If somebody's visa is being refused by when the person can reapply?

e>In SET(O)Guide Form in the Who may apply on this part>in Long Residence in UK section its being mentioned that if u include applications by dependants it will be refused. This section is bit foggy for me.It will be real help if u could also highlight on this..............
Sorry to bother you with so many questions .
Thanking you in advance.Ur help will be highly appreciated....
