can we go for admin review

Post by allgo » Sat Jan 15, 2011 8:05 pm

Hi moderators and fellow members
I had posted about my wife's visa rejection on this thread.
http://www.immigrationboards.com/viewtopic.php?t=70124

She has been given right to appeal and I have posted some appeal related question over there.

But as we know appeal may take longer - can I actually go for an admin review myself? not too sure which address to mail the admin review form though.
Reason is in this case it is evidently a case of overlook by the caseworker where he didnt even notice the original bank statement and just saw the photocopies submitted( we need to submit photocopies of originals in vfs) and took his decision in rash. Isnt it more a case of simple admin review?

Please advice if I can still go for admin review.

Thanks in advance

No you can't go for admin review for the reasons already explained in your previous thread. Admin review is for cases that do not attract a proper right of appeal to the tribunal.

You can submit representations and details grounds of appeal and the decision will be reviewed by the entry clearance manager before the appeal goes ahead. if the case is as straightforward as you say than there is every chance that the case will not need to go to a hearing.

Thanks Greenie
Even in that case how long normally does it take since sending the appeal to hear from the ECM?
in case it takes long I guess I will anyways ask my wife to reapply but do I need to mention I have a pending appeal. I am just concerned that whether it jeopardizes the outcome of a fresh application. Also a bit scared after the case worker actually made such a glaring mistake(if my guess is right)
