Dependents question (ILR) - Tier 1

Hi

I am hoping to file ILR in May-2011. My wife has also been in UK for last 3 years although on independent visa i.e. tier2 & tier 1. She she will be able to file the same in 2013.

She has been been staying with me for last 2 years. Does this mean she will be able to file for ILR as a dependent?

I am applying on tier 1 and she is also on tier 1. does it mean she will need to switch to dependent and then apply?

If she first obtains entry clearance as your dependant, then she may apply for ILR together with you.

For her to switch to your dependent, she will need to leave the country and apply for new visa from home country.
