Employer not been paying tax/NI:problem?

Employer not been paying tax/NI:problem?

My brother in law is here on Tier 1(G) visa expires Sept 2011: he has been working 2nd job as lecturer in private college to boost his income getting average £600 pm for last 6 months but now college says they have always consider him self employed and they do't intend to pay his tax/NI; will this affect his earnings ie will they check with tax office and see tax only paid on his main job of £28,000 (he needs to earn £35,00 to make enough points), AND does anyone know if he must apply for his extention before April 2011 (due to tier 1 ending) or will there be some kind of transitional scheme for existing Tier 1 migrants like my brother in law to continue to apply for an extention nearer to their original visa expiry date ie after April 2011?

Pls reply as he is very worried thanks all

If your brother in law has not paid tax for the amount he is earning on his 2nd job he can visit the nearest jobcentre plus office and ask for help and they would do that and then he can pay tax for the amount..

yes you have to pay tax for all your jobs and you never know whether home office would inquire with HMRC..so to be on safe side..do that..

no one know what rule changes are going to take place after april 2011 so its ur brother in law's call whether to apply early or not...

If you have been cheated and you have some evidence like (pay slips, contract of employment etc) then hire a solicitor, he/she will act on your behalf and will write to your employer OR you should complain govt authorities.

If doing so can cause your employment to over then other option is always there. Get self employed and pay your taxes yourself.

Please confirm, how the college paid your brother? Cash, cheque or abbk transfer.
