Revoking ILR

Hi

I have a question to ask. My Husband and I have been married for 7 years and we submitted his ILR application about 3 weeks ago and it was granted. Unfortunately I cannot go on any longer with the marriage as I am so unhappy. He is a good man but we just don't get along any more. I kept on going as I didn't want to rock the boat before his ILR, but we have now decided to separate and I do not want to hurt him or take away his ILR. I am a bit concerned though as today I made a claim for tax credits. We used to claim together, but have not recieved any payments since April 2010 as our income was above the threshold. Therefore today they closed down our joint application and set up a new one for me in just my name. I am worried sick now that HMRC will inform Home Office or that Home Office will somehow pick up the information and they will think it was a marriage of convienience and think that we were fraudulently submitting the application. I am so nervous please advise.

you were married for 7 years, that's more than a lot of people !

ILR can only be revoked in these circumstances if UKBA think it was obtained by deception. I think it's improbably that HMRC would inform UKBA but even if they did it's unlikely UKBA would do anything about it.

Thanks ever so much for your reply. I have been sitting here all night feeling sick with worry. Its been a long journey and such a shame that at the final hurdle we fell. But we tried. Like you said 7 years is more than most.

There's no way the HO are going to be informed of this by HMRC.
