Tier 1 refusal. no uplift ratio for earning

Tier 1 refusal. no uplift ratio for earning

I was not physically present in the country for the whole duration of the job I claimed earning from and so no uplift will be applied and application refused. Does this sound right? has anyone been in that situation? any advice? no right of appeal

If you don't apply an uplift ratio to your foreign earnings and directly convert into GBP, would you have attained enough points within the previous earnings criteria?

I also have the same issue - all earnings for extension were made overseas.

The job was for two weeks. I was in UK for the first week and overseas the second week which was when I was paid. But still dont understand why HO will not apply uplift for me. without the uplift, point for earning will not be enough for me to be eligible.

it is extremely clear that you have to be physically present overseas to apply uplift ratio on overseas earning. There is absolutely no ambiguity.

Are you saying that HO is right? because I feel the case worker went a bit too far by saying that I have to be physically present for the WHOLE duration of the job. the least I will expect is a pro rata.

I do not know about split etc.. But the requirement to be physically present to use uplift is written in the policy guidance.. I have read it so many times.. whether he can use pro-rated I do not know but I am sure if you would have considered only the period you were there, it would have been fine. It is difficult to expect they would do it proactively.

When I applied in 2008, I had a mix of uplifted and not uplifted income and so I did lot of study on this rule that time. I guess the rule is still the same.

hi my friend..
1. you can apply uplift ratio only for fresh tier1-general application.
to eligible for this uplift we need to be physically present in the source income country.

2.no uplift ratio applied for tier 1 extension. for this all foreign earnings directly converted in to pounds. no mater where you stay.
