Hi,

I have ILR and my wife has switched to dependent from hsmp when i got my ILR. We have a child (16 months) born in UK and he got ILR at the same time as i. I think i will be eligible to apply for Naturalisation in May this year. I have a couple of questions related to my son.

1. As his mother doesn't have ILR, can we register him as Citizen?
2. if answer to above question is YES, If i register (MN1) now, is there a time limit to apply for british passport for him? I ask this question as i intend to apply for his passport only when i am ready to apply for myself. But thought if i can complete his registration now then i will have one thing less to do in May.

I appreciate any inputs and thanks for your time!

See also child born in UK. A British citizen may apply for a British passport at any time.

Hi Vinny,

So as per this text i can apply for MN1 now

(3)A person born in the United Kingdom after commencement who is not a British citizen by virtue of subsection (1) [F7, (1A)] or (2) shall be entitled to be registered as a British citizen if, while he is a minor—
(a)his father or mother becomes a British citizen or becomes settled in the United Kingdom; and
(b)an application is made for his registration as a British citizen.

I think i have not explained my question 2 very well.

If i manage to register my son successfully,

does that mean he lost his Indian Citizenship? Do we have to return his Indian passport before we apply for his British passport?
