Question re restrictions on working prior to HSMP approval

Post by chowderhead » Wed May 31, 2006 10:05 am

My HSMP application is in process (I got a reference # yesterday, and faxed the Urgent Treatment form) and I have a job offer and they want me to start ASAP. I have a US passport. I understand I cannot work in the UK before my HSMP is approved and I get Entry Clearance. My questions are the following:

1) Can I work for a UK-based company while I'm physically in Finland or Spain, while my HSMP application is in process? My new company has projects in both countries. In other words, can I perform work for the company whilst I'm outside the UK and still stay on the right side of UK immigration law?

2) The address for my HSMP application is in the US. If I get HSMP approval, must I go back to the US and reenter from there or can I get entry clearance and reenter the UK from the Finland/Spain? (assuming I don't mind Fedexing my passport and the HSMP approval letter to get the Entry Clearance)

3) If I perform work for the Company whilst outside the UK but in the EU, am I breaking any EU laws?

Any feedback would be appreciated.

Thanks,

James

According to my Limited knowledge, for visa nationals, you can apply for EC from Spain/Finland as long as you are on resident status in that country.

James,

There is an "urgent treatment" form you can fax to the Home Office. I've heard if you have a job offer they can pull your file and expedite it for no charge. Might be worth a shot.
