Is he still allowed to stay?

My husbands initial 2 yr visa ran out at the ed of last week, he thought it was valid for another month, and only realised when filling out his SET(M) form. We called Border Agency who advised us to send in an extension form asap as he hasnt sat his test yet (on the18th). We sent this off this morning as soon as we found out explaining he thought he had another month left on his visa.
Is he entitled to stay now this application is in, we had to send in his passport etc so he cant leave???
