Help required regarding Tier 1 earnings

Post by arbutt » Thu Feb 10, 2011 1:46 pm

Hi,

I am on Tier 2 (General) visa sponsored by my main employer. My job is a partnership between the main employer and another company where the other company is 33% partner in the whole partnership. I am working full-time at the company site, however my payslips comes through the main employer.

Now, the company is giving me my due bonus directly through their payroll and NOT through the main employer to avoid complex procedures at the main employer's HR. My question is can I claim this bonus as my earnings in my Tier 1 application? If the answer is Yes, then would a letter from the company and my bank statement be enough as a proof of this earning?

Please answer considering the fact that I cannot go self employed.

I would appreciate your response.

IMHO, you cannot claim to have been paid salary by one employer and bonus by another. Doesn't make sense, at least to me!

Thanks for your reply. I know this does not make sense in normal circumstances. However, as per partnership agreement, any increment or bonus in my salary must have to be contributed by the company.

The only question is whether its acceptable if the company pays it on their payslip?

UKBA is not concerned with the nature of inter-company agreements. If you don't mind losing the application fees, give it a try.

IMHO, it is highly likely that the bonus amount will not be taken into consideration.
