Query re: ILE for baby born outside UK

Post by sunshine110 » Sat Feb 05, 2011 8:34 pm

Dear Seniors,

I am posting this query after considerable research and need to clarify/seek opinion on a few points.
My wife and me were granted ILR in September 2010. A few weeks after that, in October 2010, my wife travelled to India to give birth to our baby. The baby was born in December 2010. Now I wish to apply for ILR/ILE for my baby.
Here are a few things I need to clarify:

1. Are forms VAF4A and SU7/01 the correct forms?

2. As the baby cannot fill form VAF4A, who should sign the form on behalf of th baby? I assume it should be the mother in India, but the form does not have an option of a parent signing on behalf of their children.

3. As a sponsor what documents should I send to the ECO in India. I have collected the following.
- Form SU7/01
- Covering letter
- 3 months bank statements
- 3 months payslips
- Employment contract
- Birth certificate of my baby, naming me as his father
- Copy of my passport, including my visa page confirming the ILR status.
In addition to the above, I have to submit my accomodation details to satisfy the ECO that I have adequate accomodation. This is where my dilema starts. Soon after my wife went to India, I shifted out of my rented place and moved in with a friend. (to save some money in these tough times). As the property is owned by my friend, I do not have any utility bills or rent agreement. I do pay my friend a small amount of rent and I have every intention to rent a place before my wife and baby come back to the UK. Now how do I articulate this on the ILE application? My friend is ready to provide a letter confirming I stay with him and that he is willing to accomodate my wife in his house as long as I please. Would this be enough?

Would very much appreciate your help in clearing the above points.
thanks.

I don't think that the SU7/01 is required for child settlement visa applications.
Settlement form guidance notes wrote:An application for a person under the age of 18 may be completed and signed by the parent or legal guardian.

You have to complete two applications and the original documents only one so they keep both applications in the same folder.

When i applied for my baby and wife i did submitted two forms and one set of original documents. You can carry one set of photocopies of your documents incase they need it.
