Hi,

I would be very grateful if someone could advise me on some matters before I submit my FLR (M) application.

I have been living continously in the UK since Sept 2002, as a student. In June 2010, my partner and me got married in May 2010. Since then, I have changed my status to a dependant of Tier 1 Post Study Worker where this visa will expire in Oct 2011. Now in Feb 2011, my husband who is previously a Tier 1 PSW visa holder, has been granted ILR (on basis of 10 years residency). I would like to submit my application as a partner of a person settled in the UK.

My first question is:

As far as I understand from UKBA website, in order to submit an application of FLR(M), I am required to provide evidences of English skills. My BA degree in English Language Studies (taught in English) is not from a majority English-speaking country but I have obtained a MA degree from a UK university. Do I still need to get a confirmation letter from NARIC in order to fulfil the English skills requirement?


Second question is:

When can I apply for ILR? In June 2012 (after 24 months including time spent as a dependant of Tier 1 PSW) or in Sept 2012 (on my own due to 10 years residency) or March 2013 (completion of 24 months as a partner of a settled person in the UK)?

Yes.

Based on the information given, the earliest you may be eligible to apply for settlement is in June 2012 (287(d)).

I thought the statement was referring to Master's degrees or PHDs which were obtained from non English-speaking countries while mine is from the UK. Well, I guess I have to spend a little bit more for the higher success rate in my application :wink:
