Eligibility to apply for ILR

Hello,

I want to check if I can apply for the PR and if I would be granted the same.

I first came to UK on 17th July, 2005 on work permit. But I had to go back to India on 23rd March, 2006 as the project I was working for was shifted to India for a few months.
I came back to UK again on 11th July, 2006 to work for the same project. And again I had to go back to India on 11th Feb 2007 as the Project was once again shifted to India. While I was in India my Work Permit got expired and I had to apply for a new work Permit. I got a new work permit and then travelled back to UK on 16th July 2007 and since then I am in UK.

In a nut shell I have completed more than 5 years in UK but with two breaks in between each of more than 3 months and in between I got a new work permit from India. During the breaks in India, I was working for the same project.

Please, let me know if I can apply for the PR and if I would be granted the same??

As you state that the WP expired and you had to get a new one issued from outside the UK, the ILR time would have been reset and would start again from Jul 2007..hence ILR time would be Jul 2012.. provided you are within the requirement for the number of days outside the UK and also if you are not on the ICT visa as that route is now closed for settlement from April 2010

IMO your ILR clock reset in 2007 and re-started on the date when you entered UK after getting work permit in 2007.

you will qualify for ILR in 2012, if (and its a big IF) rules stay the same.
