Hi,
I will be applying for ILR next week based on 2 years of WP + 2 years of HSMP + 1 year of T1 General, and my wife will be applying at the same time as my dependent. We have some questions regarding the application and the SET(O) form, and we will be very grateful to anyone that may help us about these questions.
1) In the SET(O) form, how should I make clear that I am applying based on the combination of WP+HSMP+Tier 1 leaves? Specifically, in Section 3, should I just tick 'Tier 1 (General)'? or all three of 'Work permit holder', 'Highly skilled migrant' and 'Tier 1 (General)'? or 'Other purposes or reasons not covered by other application forms' and state the categories in the box below?
2) My wife switched from PSW to my dependent about 3 weeks ago, just to enable her to apply as my dependent for ILR. Although we started our relationship over five years ago, and we have lived together since September 2008, we only got married in September 2009 (less than two years ago). Would this affect her eligibility? Do we need to supply proof for our co-habitation?
3) Question 6.1 says 'When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.' I actually first entered the UK in 2002, and was then granted leave to remain as a WP holder in Mar 2006. Shall I use Mar 2006 as the answer here?
4) I guess I should use 9L in Section 9 for documents, which says 'Tier 1 (General) migrant If you are applying for indefinite leave to remain on completing 5 years’ continuous stay in the UK made up of leave as a Tier 1 (General) migrant and leave as a highly skilled migrant, work permit holder...'. Is this correct?
5) I have about 100 days of absence from UK but all of them are paid leaves. Do I need any other proof for this? or the payslips will do?
Sorry that the questions are a bit lengthy as we are trying to make them clear. Any answers and advice will be much appreciated. Thanks very much.
