Tier 1 General Visa Refused - Urgent Help Guidance Required

Hi,

cI need some advice for my cousin, who received his Tier 1 rejection Letter today. There are two reasons given for the rejection as follows:

1) We are unable to verify the claimed self employed earnings and have not calculated these in your previous earnings total as you have failed to provide invoices as outline in the published guidance updated 23 Dec 2010 paragraph 139 (x)

2) Additionally you have failed to provide documents to show that you were registered as self employed for the whole period this money was earned as per paragraph 138 of the updated published guidance notes.

The question is accountant sent balance sheet which is similar to invoices, there was not any verification received to accountant and there was also HM revenue document submitted to Home Office which explain point 2.

Home office has not given any right to appeal, however they have given an opprituanity to re apply.

Please give your suggestions. Your quick response will be much appreciated.

What is "balance sheet similar to invoices"? Invoices are, IMHO ... invoices!

Verification of invoices is done with the clients (against whom the invoices are issued) and not with the accountant / applicant.

An accountant / self-employed applicant can create invoices but cannot expect UKBA to verify the authenticity of these invoices (and payments) from the accountant / applicant (issuer of these documents). UKBA verifies with clients to ensure that the applicant has provided services to named clients (as claimed in the application) and the clients have paid for these services (as also claimed in the application).

So do u suggest to submit the invoice as all the invoices are available along with the client details.

Please note HO has not given any opprituanity to appeal.

If you are not given right to appeal (because e.g. - current leave hasn't expired) then you need to make a new application with the "correct" documentary evidence(s) as specified in the policy guidance.
