Mrraying Abroad to UK CItizen while on Tier 4

Post by stevenage » Thu Feb 24, 2011 11:08 am

Hi, I have applied for COA at the end of January 2011, and my leave is expiring by 30 April 2011 ( Tier 4). As there is possibility that my COA will nor arrive before my leave expires, we are planning to marry in Jersey and then comeback and apply for spouse visa. Now I am confused with the situation that when I enter UK back will the immigration staff will stop me and refuse my entry on the basis that my studies has finished so I should not enter ? If so then is this enough that I tell me them I have to apply for spouse visa ?

Regards.

If you are travelling to or from the Republic of Ireland, the Channel Islands or the Isle of Man wrote:The UK does not make routine immigration checks on passenger travel within the CTA, and passengers are not required to carry a passport or national identity document for immigration purposes. The CTA is a 'free movement' zone, based on the principle that a person who has been allowed to enter one part of the CTA will not normally require permission to enter another part of it while that permission is extent (provided they do not leave the CTA).
Do check beforehand if you can marry in Jersey without a CoA.

Just one more question,

As going through this forum, I understand that as a proof of contact we have to show text messages, emails, phone calls etc. My and my partner are working together for three years and we decided to get marry soon after I complete my course. She was using mobile contract and last year the contract expired and she was using PAUG sim and now my sim from december. She dont use internet. The evidence we have is cards on different occasions, gifts exchanged, and that we are working together at the same placefor last three years. Is that enough evidence ?

Hi Sushdmehta, Just got this info from jersey.com. I understand but just your expert opinion, I can travel to jersey without my passport and biomatric ID card as they are with HO, I shall carry the Acknowledgement letter from HO. Is that fine.

Holders of a passport / identity card from a country outside the EU

Provided that you are lawfully in the UK and will be travelling within the validity of your immigration permission, you will not require a separate visa to travel to Jersey.
As there are no immigration controls between Jersey and the UK, you will not be required to present yourself to an immigration officer on arrival in the Island.

However, due to increased security measures at British ports of entry, we would advise all members of the travelling public to carry a form of photographic ID. If you do not have such documents, it would be wise for you to carry a letter from the Home Office confirming your residential status in the UK.

Many people who make out-of-time application may have their passports / BRP with UKBA but that doesn't mean that they have valid leave to remain in the UK. And an acknowledgment letter proves nothing but that UKBA has received an application! It doesn't prove that you had leave to remain in the UK ... and therefore do not require a visa to travel to Jersey! But yes, they can always check with UKBA about your status, quoting the reference number given in the letter

Another question is - will you be able to marry in Jersey without a passport in possession, given that you are a non-EEA citizen? Check beforehand.
