is my wife eligible for ILR?

Hello there!

I am not sure if this question has been answered before. I am getting married this April and than my wife is going to apply for my dependent visa from the home country. I am on a tier 1 visa and going to complete my 5 years this October. My question is that, when I apply for my ILR, my wife is going to get ILR as well or she has to stay here for 2 years before she is eligible for ILR.

I think you can included your wife as your dependent in your ILR application and she need to pass KOL test.

Are you covered by HSMP JR? If yes, then, as per immigration rules, she will be eligible for settlement at the same time as you. See also ILR dependant.

If not, then, under current rules, she must spend 2 years in the UK to be eligible for settlement.

Thank you very much guys for your reply. I am not sure if I am covered by JR. But i got my HSMP pre nov 2006. I know that much that I am exempt from taking life in the UK test for my ILR, but i have to complete 5 years for my ILR.

Any idea what sort of rules applies on me.

But i got my HSMP pre nov 2006.

You are covered by HSMP JR, though the residential qualifying period for settlement in your case is 5 years (not 4). KOL not required (by any applicant) at the time of settlement.
