Hello,

I`m currently in the UK on Student visa under Tier 4 and wanted to swich to PSW after copleting my studies, but now when the PSW might close, I`m considering to marry or apply for unmarried partners visa with my boyfriend. My student visa expires in December 2011. But there is one problem: My boyfriend doesnt have a job at the moment and started to claim benefits about 5 months ago (we didnt know that PSW will be closed, so weren`t worry about my visa situation).
Is it possible for us to apply for permision to get married if he has no job and claims benefits?
In fact, I study MBA and work part time as a trainee accountant for a good salary. Can it help me in obtaining a spouse visa?

Yes sounds like your situation is stable enough to apply for flr(m). Just make sure you have £103/week left over after rent and council tax.

Hi!
Thanks guys for your reply. My boyfriend is British!
I am a bit conserned about him getting benefits and no working. I`m afraid that it`s might affect the HO decision. I need to provide evidence of his finansial situation (statements, payslips ect...). He has a bank account and some savings but, he doesn`t have payslips and he also claims housing benefits... Can anybody tell me how it might affect the application?

And ElenaW, thanks for your respond. We don`t pay rent and counsil tax. He claims Housing benefits and it fully covers our rent.

Are your earnings being disclosed to the office that deals with the HB and CTB claims?

No. The rent contract is on his name. I suppose to live with my relatives in London but I live in my Bf`s place most of the time.

Sorry, the only words I feel able to use, having read your post, are ..... benefit fraud.

If you are indeed living together I strongly recommend that your income be reported to the office dealing with the HB and CTB claims.

I don`t think its a fraud. I`m registered at another address, where I have a room and pay rent to my relatives. I also pay part of the utility bills for them too. I have GP registered at that address. Im just staying with my boyfriend most of the time. There is nothing wrong with that. Why I should pay rent in both places.... :roll:

Of course ,If we decide to apply for a marrige visa, I will completely move in with him and we will inform the council about the changes. But my concern is not about this, my concern is- can I apply for a marrige visa in this situation... I don`t want to get refusal because of my bf doesn`t have income. He doesn`t mind even to stop his benefits if this will help me, but he can`t work due to his health issues.

Good luck. Hopefully you will tell the Council, before their benefit fraud investigation team come knocking on the door early one morning. Far better that you tell them first.

I didn't make the rules. It is you that have posted "since we moved in together" and "Im just staying with my boyfriend most of the time.". So no doubt in my mind what you need to do.
