Dependant Tier1 visa

Post by kej » Sun Mar 06, 2011 3:07 pm

Hello,

My boyfriend has Tier 1 visa since Apr 2010, and has been living in UK for about 10 months now. At the moment he is searching for a job.

We have been together for about 2 and half years now, and we would like to live together in UK after he finds a job, which should be in the next month or so. Here in Croatia i have a job and i have a MA diploma.

so if someone could point out what are our options?

i would be grateful.

One of the requirements for entry clearance as (an unmarried partner) dependant of Tier 1 (General) migrant is:
319C wrote:(c) (iii) the applicant and the Relevant Points Based System Migrant must have been living together in a relationship similar to marriage or civil partnership for a period of at least 2 years.

When you two are married then you may apply for entry clearance as a (spouse) dependant of a Tier 1 (General) migrant.

To marry in the UK, you'll need to apply for "visitor (marriage) visa". Please also note that you'll not be able to change status from visitor to dependant of Tier 1 (General) from within the UK.

Easy solution - marry outside the UK.

As per the policy guidance / immigration rules, there is no requirement that the Tier 1 (General) migrant in the UK must be employed or self-employed when a dependant applies for entry clearance (319C).
