Query on Tier 2 ICT for ILR

Post by dreamerB » Tue Mar 08, 2011 4:24 pm

Hello,
I entered UK on 07 July 2006 on a WorkPermit. Left on 01-July 2007 and re-entered 07-July 2007 (for the same project, on the same permit). I have been here ever since and am currently on a Tier 2 ICT valid till July 2012. The question I have is, in the employment letter, my start date is mentioned as October 2007. This is because of my re-entry. During that period (July 2007 - September 2007), my Payroll was processed in India.
- Will this reset my continuous stay?
- Or, would they only take a look at the stamp dates on my Passport?

What about your employment prior to october 2007?

You said that you left UK for 6 days in July 07. Did you have a valid UK visa during this time? If it was a work permit, then were you paid in the UK during this time?

Yes, I did have a valid Work permit during that time. No, I was not paid in the UK during the interim period. I was paid by my company in India.

TEchnically i think thats a breach of work permit requirements. Your company should have cancelled your work permit when you were being paid in India. However it may or may not be noticed by case worker as you had a valid visa during that time. Sticking point might be if you to get a letter from your employer confirming that you started in July 06.
