Tier 1 General Refusal

Post by sonig » Sat Mar 12, 2011 1:07 am

Dear friends please guide me,

I have applied for Tier 1 General on 12th of feb.
I got points for all the sections except for earning.
I have shown earning from two sources; 1) Paye (GBP 21000) and 2) Dividend from company where i am 50% share holder (GBP 17222.21).

Reason for rejection:
You have claimed points for earnings of 17222.21 from self employment with Company XYZ
As specified in the published guidance, applicant must provide evidence of paying class 2 national insurance contribution to the HMRC during the period claimed for self employment.
As evidence of your previous earning from company XYZ you have provided Dividend vouchers, Business statement, Accounts and an Accountant letter.
As you have provided no evidence of paying class 2 National insurance contribution during the period claimed for self employment we are unable to award points for these earnings. furthermore your accountant's letter does not meet the requirement for the award of points as it does not state that your accountant is registered with the appropriate body as specified in the Tier 1 guidance.

I have confirmed with Tax Revenue that being director of a company i dont have to pay any Class 2 National insurance. And most importantly my case doesnt come under self employment.

My Accountant is certified and its mentioned on his letter head. Home office has also contacted him and asked for his registration details which he has provided on time.

Ill appreciate if any of you will help me with my application.

thank you in advance.

Gsoni.

Sorry, I don't know anything about the specifics.

But it sounds like the decision is wrong, at least with respect to the account.

Can you apply for an administrative review? That's all about 'incorrect decisions'.
