Tier 1 (General) - Maintenance funds question - HELP!!

Hello

I am 32 with a wife and kid and we have been living in the UK for nearly 3 years on UK work permit.

I have been meaning to transfer to Tier-1 for a long time but never got around to doing so. Unfortunately, I now realize that I have only until end of this month to send my application.

- The key problem is I don't have a history of maintaining more that £800 for the last 3 months
- I have been earning £50000 and over for the last 2 years but most of it goes to my MBA loan
- I have Masters from USA and MBA from top university in UK, from where I graduated in 2008
- my work permit visa expires only in 2013. So we have the right to stay until then

QUESTIONS
========
1) Can I submit my application (individual) knowing fully well that I don't satisfy the maintenance requirement? - Ideally, I would have waited for 3 months to accumulate the £800 requirement BUT now I don't have time

2) What are the benefits of submitting my own application now and the dependent's later?

3) If this is rejected, will it be a black mark in my passport?

Hi, Your application will be refused. I know of similar cases with people earning >£90,000 even , but with didnt maintain the funds in an instant account and hence had to wait till the 3 months period was over (in a current account).

You can surely try...maybe with accounts over seas. As long as account is instant acess.

Hi,

high chance of your application getting rejected with insufficient funds. so its better to find a way to show the funds maintenance before you apply.

I am not sure about this, experts can throw more light, AFAIK It won't be a black mark in your passport but you would have to mention that everywhere whenever you are applying visa anywhere else that a UK visa have been rejected for this reason.
