hi all,
I applied last month for tier 1 general which is one month before my visa expiry but I got my application returned as the photo I submitted did not meet their requirements. The problem is they sent back the application from home office on march 10th which is one day after my visa expiry but as I have no choice but to apply again I made a fresh application and sent them on march 11th which is 2 days after my visa expired. Can anyone please suggest whether they consider this as an overstay application or a normal application like the one applied first time..

Did they give you a time frame in which to respond?

UKBA will consider the status of the application using their discreation.
However, you can always argue & appeal if the decision is not on your favour just for out of time application.
