Outstanding Deportation Order

Outstanding Deportation Order

I am legally living in Ireland and have Long term residency visa in Ireland, I am married to British citizen and want to visit UK with my wife. but the problem is that UK Embassy wont isue me visa because I have outstanding deportation order in UK and there is still 7 years remaining on it.

I would like to ask that how can I apply for deportation order to be removed ?

any advice guys ??? from where shall I start ??

why were you deported? How long was your sentence and what was it for?

Were you married to your wife of the deportation?

Do you have any children?

Has anything changed since you were deported?

Because I was overstay and in UK it is the law now that if you overstay they deport you and put condition on you.when police stoped me I gave them my false name and was sentenced for 1 month. deportaion order was for 10 years, 7 years left now

I was married to my wife 2 years before deportation and my wife was pregnent that time (she lost baby because of the depresion later) and home office and judges accept our marriage but didnt want to give me visa, they said your wife can go with you.

my father in law is very ill and he goes to the hospital everyweek and stay there for 1 or 2 days. doctor say that he is serious. I want to see him

Have you actually been served with a deportation order following a criminal offence or were you just forcibly removed from the UK. There is a difference between deportation and administrative removal.

I know, deportation order was signed after I left UK voluntarily whick stands for 10 years from 2007, My solicitor told me.

how can I apply for deportation order to be revoaked ??

i dont understand how you would have been served with a deportation order for an offence which resulted in you spending only one month in prison. Usually the sentence is at least 12 months.

What was your offence and how long was your sentence?

it was a minor crime usually not even given a prison sentence when some one commit this crime. Police stoped me and I gave them my wrone name and date of birth, then within few minutes I accepted my fault and told them my reall name and why I lied, I lied because I was overstayed. I do not have any criminal history, it was my first crime and it says in the report from police officer that I was very co-operative with them and in other report it says that I panic thats why I gave my false details and there is ver low chances of me commiting some other crime again.I was given 2 months sentence and judge recommend deportation.

To me it all looks like a plan, home office and Criminal court knows that if they dont give me prison sentence they cant deport me so first they gave me minimum sentence and then home office decided to deport me and gave me right to appeal, I did appeal and was refused.

even my solicitor and barrister was serprised from this decision. they said if you was sentenced for 12 months or more then court recommend deportation. or may be I was just unlucky.

can someone please tell me that how can I apply for the deportation order to be revoaked ??

I find it very unusual that you have been deported for an offence of this nature.

nevertheless please read this guidance which explains how to apply for a deportation order to be revoked and the circumstances in which an order can be revoked.

Note according to this document if the order was signed after you left the country it may be considered invalid.

I know its very unusual, it was a minor crime.
