Question about dependant - ILR

Question about dependant - ILR

Hi,

I have a quick question about dependant. I will be ready to apply mid April for ILR. My wife and I got married last year September. So she hasn't been living with me for 2 years. She can apply with me but only on FLR (M)? and she doesn't need to pass life in uk test or anything at this stage, right?

What is the visa status of both applicants. If you are on old work permit then there is no requirement for dependants to be living with you for 2 years.

Your wife can not apply with you as FLR(M) is for partners of settled person. You wont be a "settled person" till you have ILR visa stamped on your passport. So you need to get your ILR first then your wife may apply using FLR(M).

Thanks for info xyz123. I was on WP but since 2008 I'm on Tier 1 General. She's come as my dependant on Tier 1 last year. So If we I want to apply in person at croydon, she can't come with me and apply ?

Possible, but you will need two separate appointments - one for you (ILR) and then another for your wife (FLR). And unless you are granted ILR she cannot apply for FLR, so make sure there is couple of hours' time between the two appointments.

Thanks a lot once again sushdmehta. This is interesting. If I understand right, that means, I can get my ILR and she would do nothing for the moment and later she can get her extension...

Note that A1 is also required for FLR(M).

There is no A1 level for IELTS. the minimum they show is B1 and it's 4.0 for IELTS. so that'd be more than enough I believe...
