How will Tier 1 General applicants meet the earning requirements for Indefinite Leave to remain from April 6 using point based system.

Are we going to provide evidence of earnings for the whole 5 years of qualifying period through P60 and/or tax returns for self employed.
or we are going to provide evidence of earnings for only the previous 12 months of the 5th year.
The reason i am raising this point is that someone like me has not made earnings up to the previous earnings i used to qualify initially due to global recession.

Can we all share our opinions please.I have the feeling some people already knew what is going to happen.
I was happy initially because it is point based but when i was discussing with some friends,my mood changed.
Is this blessing in disguise or the opposite?.

After having read the draft regulation here's my take on it.

HSMP JR - not affected
WP pre 2006 - not affected

Tier 1 granted before 6 April 2010 - you need to score 75 points according to table 2, + criminality threshold

Tier 1 granted between 6 April 2010 and 19 July 2010 - you need to score 75 points from table 3 + criminality threshold


Tier 1 granted after 19 July 2010
- you need to score 80 points from table 3 + criminality threshold


I think we're all waiting to find out what evidence we need to supply.

I think you have to meet (or exceed) the salary criteria you used when you were first granted leave under Tier-1. (Period of assessment / Page-32)
21. (a) for all applicants the period for assessment of earnings must:
(i) consist of no more than 12 months which must run consecutively, and
(ii) fall within the 15 months immediately preceding the application.
