Confused: Which application form to use?

Post by returntotheuk » Mon Mar 28, 2011 7:16 am

Hi Folks,

I am British citizen who has lived outside of the UK for 8 years and wish to return with my wife and 3 children. However, my wife needs a visa to settle in the UK but I am little confused to which is the right one.

I thought she needed the settlement visa but on form the questions make out that I am already living in the UK which I am not. So can anyone confirm which is the right application I require.

BTW, my children have British birth certificates and passports. We have been married for 6 years, we live together and will be living together as a family in the UK.

Thanks,

you will be settling in the UK, your passport means you are free to come back and settle at any time, she can apply for leave to remain since you have been married for longer then 8 years, you will have to be her sponsor and show, accommodation, finance and proof of relationship.

Which visa application form do I use?

Strictly speaking, a British citizen who has been resident abroad but who returns to the United Kingdom to live is not ‘admitted for settlement’. However, if he/she expresses the intention of returning to the United Kingdom to reside, the ECO can regard him/her as present and settled in the UK.

Hi Again,

Thanks for the replies.

However, I think my post may have been confusing.

We have been married for 6 years but NOT living in the UK. My wife has NOT had a settlement visa for the UK nor ever lived in the Uk.

I am a full British citizen who was born in the UK with British parents and grand parents. Surely, there is no restrictions on me returning?

The visa is for my wife only.

Thanks,

Phil

My answer was intended for your wife. You're her sponsor.
