Tier 1 General extention if granted after 6 april 2011

Post by lella111 » Mon Mar 28, 2011 4:37 pm

Hi
I was granted PSW in december 2010, (3 months ago), I am self employed and I want to switch to tier 1 general before 6th April 2011.
I want to know what are the transitional arrangements for those whose Tier 1 General Visa will be granted after 6th April 2011.
Thank you

There are no "transitional arrangements" per se.

All migrants who are granted Tier 1 (General) leave based on application submitted before 06-Apr-11 will be allowed to extend their leave, as and when the time comes, just as any other existing Tier 1 (General) migrant - in line with the eligibility criteria specified in the immigration rules and associated Tier 1 (General) policy guidance.

Hi, thanks for your reply, but in the transitional arrangements announced by the home office http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

We will not apply the new requirements described
above to migrants already in the UK with leave
granted under Tier 1 or Tier 2 before 6 April 2011.

The Tier 1 (General) route will remain open in
order to enable those with existing leave to enter
or remain under Tier 1 (General), or its pre-PBS
predecessor categories2 to extend their leave. The
points threshold for extensions will, however,
be raised to 100 for those who were required
to score 100 points when they were originally
granted Tier 1 (General) leave. The points
requirements will otherwise be unchanged.

There's nothing Tier 1 General granted after 6 April 2011. I need more clarification please.
Thank you

Tier 1 (General) leave will be granted after 06-Apr-11 only for applications submitted on/before 05-Apr-11. The "date of application" is what is relevant, and not the "date of grant of leave" - therefore my response above stands.

Read Tier 1 (General) policy guidance - valid from 6 April 2011. Refer to the policy guidance available on the UKBA website near to the time of your extension (in 2013).
