Fiance Visa Rejected, Appeal Handed in Advice Please.

Hello Everyone,

My fiances visa application was refused with the following points.

1. No Wedding Arrangements.

2. Greeting Cards not in Posted Dated Envelopes

3. No Photos to show we have met (Taken out when we handed in application)

4. No Proof of Communication. (Phone cards taken out when we handed in application).

5. Relationship that only talk once a week not subsisting.

We handed in the following evidence for the appeal

•Wedding venue (Mount Zion) Booking confirmation

Phone Cards which were not accepted in previous application. 150 something in total

•Work letter which states permanent contract and pay rise and contact details for employer to confirm work undertaken and the use of phone in his working environment including contact details of my fiancés supervisor. (Cant phone in the week as at work, 5.5 hours time difference. Can only call weekends

•My fiancés air tickets to confirm his arrival in November 2010 and now after my application was refused

•My fiancés coach ticket purchased to travel to Heathrow airport when he came after my refusal

•1 large card which was not submitted previously due to size.

•Photo’s of the Valentines card and “I miss youâ€

Hi, I am not a lawyer just an ordinary person who has had a similiar thing happen. I put in many documents with my visa application (phone cards, BT bills, boarding passes, letters, photos etc etc). I, like you waited for the ECM review which upheld the decision to reject our application. We are now going to court. When we recieved the ECM letter it noted all of the evidence we had submitted in our initial application about accomodation, my earnings etc but had left out absolutely all the evidence we submitted about our relationship. I don't know if this has happened to you but I believe (from other postings as well) that ECO's deliberately or by clerical error refuse to acknowledge receipt of certain info.
If you can get a solicitor to send in all the same info you sent photos, letters, phonecards to Home office with their letter and signature when you submit then they cannot say they have not recieved it. They take more notice of a solicitor than us.

Our documents, the phone cards and photos were taken out completely by the VFS office when we handed the application in. All I have done is put them straight back in with more.

On what grounds did the ECM upheld the decision?
