Dependent on applicant on 10 year rule

Post by struggleone » Wed Mar 30, 2011 6:56 pm

Hi,

My husband is about to apply for ILR under 10 year rule. Me and my 2 elder sons have been living with him for 3 years now and my youngest was born a year ago.

Could anyone advise if we will all be granted ILR automatically should he be granted ILR under 10 year rule?

Dependants cannot be included in settlement application under long residence. When your husband is granted settlement, you may be required to apply for leave to remain as spouse / child(ren) of a settled person.

What is your husband's current immigration status? And how long have you been in UK as his "dependant"?

Where were your children born?

Hi,

My husband is on work permit, which will expires in Aug-11. Unfortunately, the employer is refusing to issue a letter to confirm him as an employee in the company, leaving us no choice but to apply for PR under 10 year rule, which is more costly for us.

All our children are born in the UK, one being 6 years old turning 7 this Aug, 3 and 1 year old. I have been in the UK with him for 10 years already.

Please advise as we are very stress at the moment with the problem with the employer being reluctant to issue the comfirmation letter.

Thanks a lot,

If eiigible, both you and your husband may apply under Long residence (separate application forms). After grant of a parent's ILR, children are entitled to register for British citizenships.
